Could I name a restaurant “Kentucky’s Fried Chicken” with the same colours and style KFC use?

thank you for your answers… but it wouldn’t be exactly the same name… there is the “s” after Kentucky. I thought a court might say it’s a different name.

Absolutely not. You’ll get slapped with a cease and desist order as soon as they find out about it. If you have a good product, you don’t need to piggyback on another company’s fame.
In Iraq, there was an ersatz KFC started up by Iraqis. KFC went after them, too.

All I’ll say is that you’d better have a very, very good lawyer. KFC will sue you, and you may even get sued by your customers.

To be honest its not a case of KFC suing you its more a case of the state of kentucky, because KFC used to pay kentucky until they changed the name from kentucky fried chicken to KFC

It doesn’t matter that it’s not EXACTLY the same name. All KFC has to prove is that the name is likely to confuse the average consumer, and I don’t think the average consumer would notice the apostrophe, especially if you use the same colors.

marion.ofsherwood, I’ve located a local list of restaurants that might help. You can drill down the Kentucky results by cities close to you. If you call nearby restaurants you can narrow down wich one would work best for you.
